The Memmingen district court had acquitted a former head of a boarding school of the charge of rape. The next instance has now confirmed this judgement.

After several months of appeal proceedings, the youth chamber at Memmingen district court has now ruled in the abuse trial against a former Marist priest and boarding school director in Mindelheim: The appeals of the public prosecutor’s office and the joint plaintiff are rejected. The district court has thus confirmed the judgement of the local court from January 2023, which acquitted the man of the rape charges but sentenced him to a suspended sentence of one year and eight months for two other sexual offences.
According to the oral reasons for the judgement given by the regional court on Monday afternoon, there are considerable doubts as to whether the events as described by the now 37-year-old man actually took place. Dr Detlef Kröger, who is representing the 37-year-old, spoke of a ‘black day’ for the Bavarian justice system and announced that he would appeal.
